Prop H |
S.F. GUN BAN DEFEATED - Bans the possession of handguns and the sale, manufacture and transfer of all firearms and ammunition in the city and county of San Francisco.
Original implementation date was January 1, 2006 but San Francisco has agreed to postpone enforcement
of the provision of Prop H that bans the sale or transfer of
any firearm or ammunition until 20 days after March 20, 2006.
Unless defeated in the courts, San Francisco gun owners will have to surrender their firearms to authorities.
Since all handgun sales are now registered in California, confiscation of firearms
from honest, peaceable citizens will presumably begin at or around June 12.

6/12/2006 - NRA WINS SAN FRANSCISCO GUN BAN LAWSUIT - Today, Superior Court Judge James Warren decided the San Francisco Proposition H Lawsuit in NRA's favor. Judge Warren agreed with NRA that the ban was in violation of state premptive law designed to fully occupy the area of firearms regulation.
According to Judge Warren's decision, current law "demonstrates the Legislature's intent to occupy, on a statewide basis, the field of residential and commercial handgun possession to the exclusion of local government entities."
Said NRA Attorney Chuck Michel, "We're thrilled that the judge recognized that law-abiding citizens who possess firearms to defend themselves and their families are part of the solution and not part of the problem."
