Description:   AB 962, De Leon. Ammunition.
   Existing law generally regulates the sale of ammunition.
   The bill would provide that no handgun ammunition vendor, as defined, shall sell, offer for sale, or display for sale, any handgun ammunition in a manner that allows that ammunition to be accessible to a purchaser without the assistance of the vendor or employee thereof.
   Existing law generally regulates what information is required to be obtained in connection with the transfer of ammunition.
   This bill would, subject to exceptions, commencing February 1, 2011, require handgun ammunition vendors to obtain a thumbprint and other information from ammunition purchasers, as specified. A violation of these provisions would be a misdemeanor.
   This bill would provide that a person enjoined from engaging in activity associated with a criminal street gang, as specified, would be prohibited from having under his or her possession, custody, or control, any ammunition. Violation of these provisions would be a misdemeanor.
   The bill would prohibit supplying or delivering, as specified, handgun ammunition to prohibited persons, as described, by persons or others who know, or by using reasonable care should know, that the recipient is a person prohibited from possessing ammunition or a minor prohibited from possessing ammunition, as specified. Violation of these provisions is a misdemeanor with specified penalties.
   The bill would provide, subject to exceptions, that commencing February 1, 2011, the delivery or transfer of ownership of handgun ammunition may only occur in a face-to-face transaction, with the deliverer or transferor being provided bona fide evidence of identity of the purchaser or other transferee. A violation of these provisions would be a misdemeanor.
   By creating new crimes, this bill would impose a state-mandated local program.
   The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
   This bill would provide that no reimbursement is required by this act for a specified reason.
 
Details:   10/13/2009 - NRA Plans Repeal of AB 962! Now that Governor Schwarzenegger has signed AB962 into law, people are already becoming aware of the damage that it will do to California and it's citizens. Therefore, the NRA and Assemblyman Hagman have agreed to amend his own already pro-gun AB373 into legislation that would repeal AB962. The newly amended AB373 will be heard in the State Legislature in January of 2010 so we must be ready for these hearings. [MORE INFO]

NOTE: Amended AB373 language is not yet available - we'll post it as soon as it becomes so.

10/12/2009 - The Governor has signed AB962, the Mail Order Ammo Ban. NRA and CRPA strongly opposed the bill. It requires:
  1. Registration and finger printing of handgun Ammo Purchasers
  2. Mandatory storage & display requirements for Ammo Dealers
  3. Ban on the Sale of Handgun Ammo through the Internet or mail order

09/11/2009 - Today, AB962 Mail order Ammo Ban passed the Assembly (44 Yes - 31 No). The bill now goes to the Governor's desk. In order for AB962 to NOT become law, the Governor must actively veto the bill within 30 days. Please contact the Governor's office and urge a veto of AB 962.

The bill was drastically amended on Friday, 9/4/2009. Some of the provisions deleted:

  1. The new license for handgun Ammo Dealers
  2. Ban on the transfer of more than 50 rounds of handgun ammo between private persons
  3. Use of the DROS Fee (background Check Fees) monies for implementation of the Program
09/09/2009 - Today, AB 962 was passed by the Senate 21 Yes - 18 No. The bill now goes back to the Assembly for a final vote. Please contact the members of the Assembly and urge a NO vote on AB 962. The Last day of session is Friday, 9/11.

09/08/2009 Update - AB962 Handgun Ammo Sales Registration - Sales Ban

The bill was drastically amended on Friday, 9/4/2009, as shown above. Stay tuned for more information. The bill can come up for a vote on Wednesday, 9/9/2009. If it passes the Senate it must go back to the Assembly for a final Vote. The Legislative Session ends on Friday, 9/11/2009.

08/27/2009 - Today, AB 962 was amended and voted out of the Senate Appropriations Committee. The bill will now go to the Senate Floor for a vote early next week. Please contact the members of the Senate and urge a NO vote on AB 962.

07/23/2009 - AB962 has been moved to the Senate Appropriations Suspense file. This means it is "stuck" in that committee at least until after the summer recess. They return August 17th. Please continue to contact the offices of the committee members and urge a NO vote on AB 962.

07/20/2009 - Today's Senate Appropriations Committee Hearing for AB 962 was canceled. Next possible hearing date is Thursday, July 23, 2009. Please continue to contact the members of the committee and urge a NO vote on AB 962.

07/16/2009 - Assembly Bill 962 is scheduled to be heard in the Senate Appropriations Committee on Monday, 7/20/2009. Please contact the members of the committee and urge a NO vote on AB 962.

07/07/2009 - Today, AB962 Handgun Ammo sales restriction passed the Senate Public Safety Committee. It will now go to the Senate Appropriations Committee. Please contact the members of the committee and urge a NO vote on AB 962.



06/20/2009 - Assembly Bill 962 is scheduled to be heard in the Senate Public Safety Committee on Tuesday, 6/30/2009. Please contact the members of the committee and urge a NO vote on AB 962.

06/11/2009 - AB 962. Ammo Restrictions, is currently before the Senate Public Safety Committee. Please contact the members of the committee and urge a NO vote on AB 962.

06/03/2009 - Today, Assembly Bill 962 passed off the Assembly floor, 42 Yes - 31 No. It now moves to Senate.

Assembly Bill 962 is currently on the Assembly floor and facing a deadline - the bill must pass the full Assembly by Friday, 6/5/2009, or it becomes a "two year bill". This means that AB 962 would have to wait until 2010 before it could be considered again. Please contact the members of the Assembly and urge a NO vote on AB 962.

05/29/2009 - Yesterday, AB 962 passed the Assembly Appropriations Committee on a Party Line Vote. The bill is being amended, details not available at this time. Standby for the next committee assignment for the bill.

05/22/2009 - Assembly Bill 962 is scheduled to be heard in the Assembly Appropriations Committee on 5/28/2009. Please contact the members of the committee and urge a NO vote on AB 962.
