URGENT LEGISLATIVE ACTIVITY

SB682 & AB496 These bills seek to repeal part of the Civil Code 1714 that deals with product liability. These bills were redrafted and gutted/amended from bills that were initially introduced to do other things. These bills were changed after the anti-gun advocates lost their "101 California Street lawsuit" against the firearms industry in the California State Supreme Court.

The repeal of current law would only open the door of litigation to the manufacturers of lawful and legal consumer products. Manufacturers of lawful products should not be held responsible for the actions of criminals or any person who uses the product in a negligent manner.

Situation: Today, Friday, August23rd, was a day of incredible twists at the Capitol!

Koretz unexpectedly brought AB496 to a floor vote! AB496 is IDENTICAL TO SB682 in language - repealing existing CA law protecting gun makers from reckless lawsuits. AB496 was voted on and FAILED with only 33 of the necessary 41 "Yes" votes. 23 voted "No" and 24 did not vote. This is thought to be a result of the MASSIVE amount of pressure brought on to the legislature by firearms owners opposed to both of these bills.

SB682 passed on Thursday, August 22nd with the bare minimum of 41 "Yes" votes only after Senator Perada circulated a "letter of intent" to the entire State Assembly. According to some legal experts, this "letter of intent" could have the same effect as amending the bill and weakening its provisions. SB682 was granted "reconsideration." This means that we will be seeing SB682 coming back again - probably on Monday. But considering that the legislature is going to be in session tomorrow (Saturday) and Sunday, they might try to sneak it back up for another vote.

Important note: There can actually be TWO votes. The first vote is for "reconsideration" and requires 41 "yes" votes, and the second vote (if the first one gets 41 or more votes) will be for the passage of the bill. So we are urging a YES vote on "reconsideration" and a NO vote on SB682.

I know that this is confusing to many of us. Especially the part about seemingly endless votes and re-votes but this is how the system operates.

Action requested:

Contact the following Assembly Members and urge them SUPPORT RECONSIDERATION & OPPOSE SB682. (Note: Sarah Reyes was instrumental in this bill passing. She is considered the 41st vote)
